CONTRACTUAL RELATIONSHIP

Magizhunthu, operating under the brand name Mag Service, provides holistic car services, including maintenance, repairs, inspections, and other automotive solutions. Your access to and use of our website www.magizhunthu.com, mobile applications, or any products or services offered through our platform (collectively, the “Platform”) are governed by these Terms and Conditions (“Terms”).

By accessing the Platform or availing of our services (“Services”), you agree to these Terms, establishing a legally binding agreement between you (“User/you”) and Mag Service (“Company/we/us/our”). If you do not agree to these Terms, you may not use the Platform or Services. These Terms supersede any prior agreements between you and Mag Service regarding the Platform or Services.

Mag Service reserves the right to modify or amend these Terms at any time to comply with applicable law or for legitimate business purposes. Any changes will be posted on the Platform, and your continued use of the Platform after such changes constitutes acceptance of the updated Terms.

These Terms are an electronic record under the Indian Contract Act, 1872, and the Information Technology Act, 2000, and do not require any digital or electronic signature.


DEFINITIONS

  • Content: Includes all forms of information or data available on the Platform, such as reviews, images, photos, videos, messages, and other materials.

  • User Content: Content uploaded, shared, or transmitted by you via the Platform.

  • Company Content: Content created and provided by Mag Service in connection with the Services, including interface design, graphics, software, reports, and other related materials.

  • Estimated Cost: The approximate cost of a service as provided by Mag Service or its service partners.

  • Membership Plan(s): Subscription or membership offers provided by Mag Service, details of which are communicated at the time of purchase.

  • Services: The car services offered through the Platform, which may include repairs, maintenance, towing, inspections, and other automotive solutions.


SERVICES

Mag Service acts as a technology platform connecting Users with independent third-party service providers for vehicle maintenance and repair. While we facilitate bookings, provide service provider information, and offer towing assistance, Mag Service does not directly perform repairs or maintenance.

You acknowledge that service costs, timing, and availability are estimates and may vary depending on the service provider and location. Mag Service will make reasonable efforts to connect you with a service provider but does not guarantee the completion of services at a specific time or location.


ELIGIBILITY

You must be at least 18 years old to use the Platform and Services. By using the Platform, you represent and warrant that you are legally capable of entering into these Terms and comply with all applicable laws. If using the Platform on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.


USE OF SERVICES

Some features of the Platform require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Services may include browsing service providers, booking services, and submitting feedback. All services must be used for genuine purposes only.

Mag Service may modify, add, or remove Services at its discretion. Certain Services may be chargeable. By using the Platform, you agree to comply with these Terms and applicable laws.

PROHIBITED USAGE OF THE PLATFORM

Users shall not engage in illegal or unauthorized activities, including:

  • Uploading false, inaccurate, or misleading information;

  • Interfering with the Platform’s operation;

  • Violating the rights of other Users or third parties;

  • Using unauthorized software or tools to access the Platform.

Mag Service may disable non-compliant content, terminate access, or disclose information to authorities if required by law.


USER COMMENTS, FEEDBACK, AND SUBMISSIONS

All feedback, comments, reviews, suggestions, or other submissions (“Comments”) made via the Platform become the property of Mag Service. Users agree that Comments do not violate third-party rights and shall not contain defamatory, unlawful, or offensive material.

Mag Service reserves the right to use, modify, or share Comments without compensation to the User. Users are responsible for their own submissions.


USER DATA

You must provide accurate and complete information when using the Platform. Mag Service may collect and use data as described in our Privacy Policy for operational, analytical, and legal purposes. Data may be shared with service providers or authorities as required by law.


INTELLECTUAL PROPERTY RIGHTS AND LICENSE

All intellectual property on the Platform, including logos, content, software, graphics, and trademarks, is owned by Mag Service or its licensors. Users are granted a limited, non-transferable, non-exclusive license to use the Platform and Services for personal purposes only. Any unauthorized commercial use or duplication is prohibited.


LIMITATION OF LIABILITY AND EXEMPTIONS

The Platform and Services are provided “as is” without warranty. Mag Service shall not be liable for indirect, incidental, or consequential damages arising from the use of the Platform or Services.

Mag Service shall not be responsible for delays, service unavailability, or damages caused by third-party service providers. Assistance may be provided in cases of vehicle theft or accidents occurring while the vehicle is in possession of the service provider.


BILLING AND CHARGES

Service charges, including third-party service fees, are your responsibility. Payments may be facilitated by Mag Service but are ultimately between you and the service provider. Membership plans, if purchased, are non-refundable except where required by law.

Failure to make payments may result in vehicle retention or recovery actions as per applicable laws.


CANCELLATION AND REFUND

Orders or bookings, once accepted, cannot be canceled or refunded, except as required by law. Customer grievances may be addressed through our dedicated grievance officer:

Complaints will be acknowledged within 48 hours and resolved within 30 days, subject to nature and complexity.


DISPUTE RESOLUTION AND GOVERNING LAW

All disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. Courts in Chennai, Tamil Nadu, shall have exclusive jurisdiction. These Terms are governed by the laws of India.


TERMINATION

Mag Service may suspend or terminate your account or access to Services for violations of these Terms. Obligations and liabilities accrued prior to termination shall survive.


INDEMNIFICATION

You agree to indemnify and hold Mag Service harmless from any claims, losses, or damages arising from your use of the Platform or violation of these Terms. Mag Service may assume the defense of any claims at its discretion.
